This company relies HEAVILY on automated emails and texts (filled with poor grammar!) so no one knows WTF you are talking about if you respond to them. He even added me to his frequent spam texting list without permission so I finally had to block his number. If you explain something is going wrong, the automatic response from this guy is to blame YOU! They dropped the ball on so many things I lost count. This decision will be based on your financial capabilities – which will be in discussion and intense scrutiny while the debt settlement negotiation is going on. If they think that you are capable of paying off your debts entirely, they may agree to lower the interest rate but still maintain the outstanding balance. They can also offer to extend your payment period to lower the monthly amount that you have to pay.
Whether you arrange a plan yourself or you use nonprofit debt relief, the plan will be reported to the credit-rating agencies and likely will affect you credit score. Your credit score will drop for the first few months of the debt management plan because you are asked to get rid of all, but one credit card that card can only be used for emergency situations. Your score will go back up soon enough, however, because you will be making on-time payments every month.
While it's possible to get negative information removed from your credit reports if it's incorrect, you likely won't be able to get negative information removed from your reports if the data is correct. For example, you cannot make a late payment go away if you truly paid a bill late and that information was reported to the credit bureaus. Only time can make true negative reporting go away, notes the FTC.
The Telemarketing Sales Rule, enforced by the Federal Trade Commission, requires companies that sell debt relief services to explain their fees and tell you about any conditions on their services before you sign up; it also prohibits companies that sell debt relief services by phone from charging a fee before they settle or reduce your debt. Your creditors may agree to lower your interest rates or waive certain fees. But it’s a good idea to check with all your creditors to be sure they offer the concessions that a credit counseling organization describes to you. A successful DMP requires you to make regular, timely payments; it could take 48 months or more to complete your DMP. Ask the credit counselor to estimate how long it will take for you to complete the plan. You may have to agree not to apply for — or use — any additional credit while you’re participating in the plan.
You can argue this issue yourself, without hiring an attorney, if you wish to. My point in suggesting hiring a lawyer is that your opponent is operating in violation of your contract. The FTC receives thousands of complaints a year, and it acts on a wholesale level against law-breakers who break the law or defraud a large number of consumers. It is unlikely an FTC lawyer will have the time to help you individually.

So, do everything you can to bring delinquent accounts up to date before you get into charge-off territory. If you are unable to make full payment to bring the account current, contact the creditor to see about working out a payment plan. This is not the time to distance yourself from the creditor. This is the time to reach out and demonstrate how much you want to bring the account into good standing.
You're the best. My mom added me as an authorized user to a couple of her cards (when I was 12, and she never even told me about it), but they're at 99% utilization and have late payments! I'm still in the process of trying to get myself removed from those, and getting those accounts completely removed from my credit report, not just listed as closed accounts.

A credit card balance transfer is another type of debt consolidation. You transfer the balances from one or more cards with high-interest rates onto a card with a low or zero percent interest rate. This gives you some interest relief. However, a major thing to take note of is if your new lower interest rate is permanent or only for a certain amount of time. While it can be an ideal situation to reduce the amount you owe, debt settlement usually requires a lot of fees to negotiate with the counterparty, takes up to 2-3 years, and can end with the creditor declining to settle. This differs from debt consolidation because it does not involve getting another loan, but they can be used in conjunction with one another.
If you work with a debt settlement company, it will usually require you to stop paying your bills while it negotiates your new settled amount, which is typically 50% to 80% of the total balance. Late payments will be reported to the credit bureaus (Experian, TransUnion and Equifax) and will stay on your credit report for seven years. These accounts could even go into collections as you wait for your debt settlement company to complete negotiations. All of these actions will have a substantial negative impact on your credit.
